DISCLAIMER OF WARRANTY: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TURF-RELATED PRODUCTS ARE PROVIDED “AS IS” WITHOUT WARRANTIES, CONDITIONS, REPRESENTATIONS OR GUARANTIES OF ANY KIND, EITHER EXPRESSED, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, SATISFACTORY QUALITY, TITLE, NONINFRINGEMENT OR FITNESS FOR A PARTICULAR PURPOSE. ARTIFICIAL GRASS RECYCLERS AND ANY AFFILIATED COMPANIES, THEIR OWNERS, EMPLOYEES, AGENTS, SUCCESSORS, AND ASSIGNS, DO NOT WARRANT THE PRODUCTS ARE ERROR FREE. BUYER BEARS THE ENTIRE RISK AS TO THE RESULTS, QUALITY AND PERFORMANCE OF THE PRODUCT(S) SHOULD THEY PROVE DEFECTIVE. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY AN ARTIFICAL GRASS LIQUIDATORS AUTHORIZED REPRESENTATIVE SHALL CREATE A WARRANTY. LIMITATION OF LIABILITY: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT AND UNDER NO LEGAL THEORY SHALL ARTIFICIAL GRASS RECYCLERS OR ANY AFFILIATED COMPANIES, THEIR OWNERS, EMPLOYEES, AGENTS, SUCCESSORS, AND ASSIGNS, OR ANY OTHER PERSON WHO HAS BEEN INVOLVED IN THE CREATION, PRODUCTION, OR DELIVERY OF ARTIFICIAL GRASS RECYCLERS AND/OR ITS PRODUCTS AND ITS OFFERINGS BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY GENERAL, DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, COVER, OR OTHER DAMAGES OF ANY CHARACTER ARISING OUT OF THE USE OF, OR INABILITY TO USE, THE PRODUCT, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, LOSS OF USE, LOSS OF PROFITS, PERFORMANCE OF THE PRODUCT(S) BEING RENDERED INEFFECTIVE, FAILURE OF THE ARTIFICIAL GRASS RECYCLERS PRODUCTS TO PERFORM WITH ANY OTHER TURF PRODUCTS, EQUIPMENT, DAMAGES FOR LOSS OF GOODWILL, BUSINESS INTERRUPTION, OR ANY AND ALL OTHER DAMAGES OR LOSSES OF WHATEVER NATURE, EVEN IF ARTIFICIAL GRASS RECYCLERS HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO WAY SHALL SELLER’S LIABILITY EXCEED THE PURCHASE PRICE OF PRODUCT.
Use of Artificial Grass Recyclers Product(s): You are not to use the Artificial Grass Recyclers Product(s) for any unlawful or abusive purpose, including but not limited to any use which disrupts the performance or quality of Artificial Grass Recyclers Product(s) or other customers, damages Artificial Grass Recyclers property, or interferes with Artificial Grass Recyclers’ ability to provide products to customers. You agree not to misrepresent your identity when using and/or installing Artificial Grass Recyclers Product(s). You agree to comply with all laws while using Artificial Grass Recyclers product(s).
Return Policy: ALL SALES ARE FINAL. ALL PURCHAES ARE
NON-RETURNABLE AND NON-REFUNDABLE.
Orders that involve any custom cutting or custom additions cannot be cancelled, changed, or returned. Any product cut to size is custom and is therefore non-returnable and non-refundable. It is the buyer’s responsibility to supply correct measurements and verify those measurements upon delivery/pick up. All turf sales are final and sold as is. For best results we recommend that a professional install turf.
Artificial Grass Recyclers cannot guarantee turf that has been improperly installed, including, but not limited to, installation in locations where turf would be exposed to extreme heat such as fire pits or other places exposed to open flame, or places were windows would reflect sunlight onto the turf surface.
This sale includes used, close-out, or remnant turf which is sold at a discount, in imperfect condition, and may contain variances in color and texture. No warranties are expressed or implied, including but not limited to the implied warranties of fitness and/or merchantability. It is the buyer’s duty to inspect product(s) prior to acceptance.
Customer has chosen to utilize its own independent installation contractor. Artificial Grass Recyclers may provide a list of installation contractors, but it does NOT recommend or guarantee their work in any way. Buyer shall negotiate terms directly with the contractor buyer chooses.
Buyer further waives and releases Artificial Grass Recyclers, and affiliated companies, their owners, employees, agents, successors, and assigns, from any and all liability arising at law or in equity from injury, death or damage to persons and/or property in the loading, transportation, unloading, installation and/or use of product by Buyer or its agents.
This is an agreement between you and Artificial Grass Recyclers related to your purchase and use of the Artificial Grass recyclers Product(s). You acknowledge that these terms and conditions are a material part of ARTIFICIAL GRASS RECYCLERS’ decision to provide ARTIFICIAL GRASS RECYCLERS product(s) to you.
